Terms & privacy

These terms set out how we work. They are written to be read rather than to be impenetrable. Nothing here replaces the specific written quote and passage agreement issued for your delivery, which takes precedence if the two ever differ.

Quotes and acceptance

Every quote is prepared for a specific vessel, route and window, and is valid for 30 days unless stated otherwise. It sets out what is included in the fee and what is billed at cost — typically fuel, berthing along the route, agents' fees, canal and lock dues, and crew travel. A delivery is confirmed when you accept the quote in writing and any agreed deposit is received.

Dates and weather

Delivery dates are estimates, not guarantees. We plan every passage to a written set of go/no-go criteria agreed with you before departure, and we will delay or divert whenever conditions, vessel condition or crew fatigue require it. Delay caused by weather, port closures, mechanical failure or third parties is not a breach of these terms, and we will keep you informed throughout.

Condition of the vessel

You confirm that the vessel is seaworthy, adequately equipped and fit for the intended passage, and that you have disclosed known defects. A documented pre-departure survey is carried out and any concern is reported before departure. Where a defect makes a passage unsafe we will not depart until it is resolved, and any resulting delay costs are for the owner's account.

Insurance

The vessel must be insured for the delivery passage by the owner, with cover extending to the intended route, season and crew arrangement. Most policies attach conditions to a delivery; you are responsible for obtaining these and providing them to us, and we will confirm the crew and passage plan to your insurer or broker before departure. Yacht Transits Limited carries its own liability insurance as an operator, which is separate from and does not replace cover on the vessel.

Fuel, berthing and expenses

Fuel is estimated in the quote and billed at cost against receipts. Berthing, harbour dues, agents' fees, canal and lock charges and crew travel are similarly passed through at cost unless the quote states that they are included. Any material additional expense is agreed with you before it is incurred.

Customs and documentation

We arrange and administer customs formalities associated with a delivery, including Temporary Admission and port clearance where applicable. We are not tax advisers. Where a movement may have VAT or customs-status consequences we will flag it, responsibility for the vessel’s fiscal status remains with the owner, who should take specialist advice.

Cancellation

If you cancel a confirmed delivery we will refund any deposit less costs already committed on your behalf — crew travel, berth reservations, agents and similar. If we cancel for any reason other than weather, vessel condition or safety, your deposit is refunded in full.

Liability

We accept responsibility for loss or damage caused by our own negligence, subject to the limits set out in the written delivery agreement. We are not liable for pre-existing defects, ordinary wear from a passage, consequential loss such as missed charters or events, or loss arising from information you did not disclose.

Governing law

These terms are entered into with Yacht Transits Limited. They and any delivery agreement are governed by French law, and the courts of France have exclusive jurisdiction, unless the written agreement for a particular delivery states otherwise.

Privacy notice

We keep this short because we collect very little.

What we collect

When you send an enquiry through this website we collect the details you type into the form: your name, email address, telephone number if you give it, and the information about the vessel and route needed to prepare a quote. We also record the page the enquiry came from and the time it was sent.

Why we hold it

Solely to respond to your enquiry, prepare a quote and, if you go ahead, carry out the delivery. We do not sell, rent or share your details with third parties for marketing, and we do not add you to a mailing list without asking.

Where it is stored

Enquiries submitted through this site are stored in Google Firebase (Firestore), hosted within the European Union, and are accessible only to Yacht Transits. Where a delivery goes ahead, the minimum necessary details are shared with the parties who need them — crew, marinas, agents, hauliers, port authorities and your insurer.

How long we keep it

Enquiries that do not lead to work are deleted after 24 months. Records relating to a delivery we carried out are kept for as long as legal, insurance and accounting obligations require.

Your rights

You can ask us at any time for a copy of what we hold about you, ask us to correct it, or ask us to delete it. Write to info@yachttransits.com and we will deal with it within one month.

Cookies
